Cymba primarily operates as an SMS data processor on behalf of our business clients. We do not supply services to the general public or public consumers. In this respect, how we process and use data is governed by the privacy policies of our clients. We only process data under strict instruction from the clients, which include robust contractual arrangements.

We appreciate that unsolicited commercial mail is a nuisance. We therefore never disclose your details to any third party for marketing purposes. We also do not send unsolicited SMS Text messages to you. Using the Company's' services will not authorise us or our client's to send any unsolicited marketing communications to you. Our client's, from whom you have requested information, is required to ask your permission before delivering any mobile communications to you. Our client is also required to act in accordance with the Data Protection Act in relation to any personal information we pass on to them. Premium SMS services must be registered and comply with the Phone Paid Services (PSA) regulations, rulings and guidelines.
Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.
Finally, if our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners.
5. Security and Protection of your information
We employ appropriate security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage.

If you interact with one of our services your information is retained for as long as necessary in order to fulfil all aspects of that service to the client, and to meet the requirements imposed by the communications regulations in force in the UK. Your information will be deleted or anonymised when it is no longer required under the above, and after a period of time set by our default data retention period (1 year) or the client’s Data Retention policy agreed with the client in question, or, if the client no longer engages Cymba’s services.
Where we hold your communications preferences with respect to a particular client, that information will be retained until such time as that client no longer uses our services.
